PROREFERIT Terms of Use
The rules governing the use of the platform.
1. Contracting parties and contractual terms
USER: Natural or legal person who uses the platform either as a business owner or self-employed professional, or as a private individual and consumer. Under this agreement, a registered user is referred to as the SERVICE PROVIDER.
SERVICE PROVIDER: Natural or legal person who uses the PLATFORM as a business owner or self-employed professional in order to manage cooperation and the referral of customers by the PARTNER and, where applicable, to pay a commission to the PARTNER.
PARTNER: Natural or legal person who, as a business owner or self-employed professional, uses the form provided by the SERVICE PROVIDER in order to refer customers to them via the PLATFORM. The partner is never part of the organisational structure of the service provider, does not belong to their company and has no employment relationship with them. The partner acts at all times as an independent business owner or self-employed professional, completely independently of both the service provider and the platform.
PLATFORM: Website developed and operated by the Spanish company PROREFERIT S.L., with tax identification number CIF B26689455. It may also hereinafter be referred to as the controller, owner, author, company or "we".
2. Purpose and functioning of the website
The main purpose of the website is to enable companies and professionals to organise, facilitate and improve referrals made to their own customers regarding other professionals and service providers by providing a secure means of contacting the recommended company (PROREFER). It also provides registered users with additional tools to manage and improve communication with their customers (PROMAIL) and to organise online events (PROEVENT).
Two types of users are distinguished: users and registered users. The latter are referred to as SERVICE PROVIDERS and always act as business owners or self-employed professionals. Relations between the PLATFORM and the SERVICE PROVIDER are primarily governed by the “Referral and Service Agreement between Service Provider, Partner and Platform” (proreferit.com/gb/contract) and the “Data Processing Agreement (DPA)” (proreferit.com/gb/dpa).
With regard to the contact forms (PROREFER), in which both the name of the SERVICE PROVIDER (recommended party) and the PARTNER (referring party) appear, the PARTNER who made the referral and through whose form the contact was established has access to the anonymised name, date and time of the contact, as well as the subject of the form. The anonymised name consists of the first letter of the first name, a full stop and part of the surname of the person completing the contact form. At least the final two letters of the surname are removed. Despite this level of anonymisation, the PARTNER only has access to this data via the platform if they are registered and have implemented their own measures to ensure data security in their capacity as data controller.
An important part of the PLATFORM SERVICE consists of verifying the quality and quantity of the services provided by SERVICE PROVIDERS and recommended by PARTNERS to their own customers. For this purpose, both the SERVICE PROVIDER and the PARTNER agree in the “Referral and Service Agreement between Service Provider, Partner and Platform” (proreferit.com/gb/contract) that the PLATFORM may carry out verification, auditing and mediation measures. For this purpose, the PLATFORM may contact users (customers) who have used the form in order to collect information about the quality and services received. As indicated in the corresponding information provided when using the form and when sending the email, participation is entirely voluntary and is intended to guarantee and improve the services offered by the SERVICE PROVIDERS.
Your contact details will under no circumstances be disclosed to third parties. The only person who receives this information is the SERVICE PROVIDER when you use a contact form on our platform. The SERVICE PROVIDER may only use your data to respond directly to your enquiry. Advertising or unsolicited communications are strictly prohibited.

With regard to the event registration forms (PROEVENT) of the SERVICE PROVIDER, the data is processed directly by the service provider organising the event. As data controller, they have implemented their own measures to ensure data security.
Within the communication management system (PROMAIL), the data is entered exclusively by the SERVICE PROVIDER, who acts as the data controller, while the PLATFORM acts solely as the data processor.
3. Data protection, forms, cookies, etc.
Our PRIVACY POLICY (proreferit.com/data) contains full details regarding the exchange of data collected through the forms, as well as the use of such data for the provision of services and operation of the platform.
We also provide information regarding the nature, scope and purpose of the processing of personal data collected, used and processed by us, the hosting service provider and third parties.
These Terms of Use are directly linked to the use of this website. Any user who does not agree with these terms or with the data protection provisions must immediately leave the website and submit their complaint to

The owner, authors and service providers reserve the right to make changes to their articles, advertisements and content published on the PLATFORM without prior notice, and to modify, delete or add content.
All links to other websites are checked when they are added. Once the destination page has been checked, we accept no responsibility for content accessible via links (hyperlinks). Users access content outside the “proreferit.com” domain at their own risk.
PROREFERIT is a registered and protected trademark. All rights to the content belong to the authors and, where applicable, to the owner of the website. Any reproduction or use of the content without the author's express written permission is prohibited.
5. Language, jurisdiction and applicable law
In the event of any discrepancy between this text and the Spanish version, the Spanish version shall prevail due to the registered office of the service provider. All relationships between the platform and non-registered users shall be governed by Spanish law, and the courts of Málaga shall have jurisdiction. This is without prejudice to the possibility that a non-registered user may be considered a consumer and may exercise their rights before the courts having jurisdiction in accordance with applicable law.
